Welcome to AIWOD (the "Service"), a functional fitness and workout generation platform. These Terms and Conditions ("Terms") govern your access to and use of our website, mobile application, and AI-powered programming services.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Medical and Physical Liability Disclaimer

PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS.

1. Not Medical Advice: AIWOD is an AI-powered tool designed to generate workout programming for educational and informational purposes only. We are not a healthcare provider, physical therapist, or certified personal trainer.

2. Assumption of Risk: Functional fitness, weightlifting, and high-intensity interval training (HIIT) involve a significant risk of physical injury or death. By using the workouts generated by this Service, you assume all inherent risks.

3. Consult a Physician: You should consult with a physician or other qualified healthcare professional before starting any new fitness program, especially if you have pre-existing injuries, medical conditions, or have been inactive.

4. Listen to Your Body: If you experience faintness, dizziness, pain, or shortness of breath at any time while exercising, you should stop immediately.

AIWOD and its creators shall not be held liable for any injuries, damages, or health complications resulting from the use or inability to use the workouts, movements, or scaling options provided by the Service.

2. AI-Generated Content Disclaimer

The workout programming, scaling suggestions, and coaching cues provided by the Service are generated automatically by artificial intelligence (AI) models.

While we use advanced filtering to prevent unsafe movement combinations, AI systems are experimental and can occasionally produce incorrect, illogical, or unsafe instructions (commonly known as "hallucinations").

You must independently evaluate the safety, load, and volume of every generated workout before attempting it.
You are solely responsible for adjusting prescribed weights (e.g., "Rx" weights), repetition counts, and movements to match your personal skill level and your available home gym equipment.

3. Subscriptions, Payments, and Billing

1. Free and Pro Tiers: The Service may offer both free access (with limited generation quotas) and paid subscription tiers ("Pro").

2. Billing: By upgrading to a paid tier, you authorize us (via our third-party payment processor, Stripe) to charge your selected payment method on a recurring monthly or annual basis.

3. Cancellations: You may cancel your subscription at any time through your account settings. Cancellations will take effect at the end of your current billing cycle.

4. Refunds: All fees paid are non-refundable. We do not provide prorated refunds for partial-month cancellations.

4. User Accounts and Data

1. Account Security: You are responsible for safeguarding your login credentials and for any activity that occurs under your account.

2. User-Generated Content: The Service allows you to input custom fitness terminology, log workout scores, and upload whiteboard photos for AI processing. You retain ownership of your data. By uploading this data, you grant us a license to process, store, and display this content solely to provide the Service to you.

3. Fair Use & Throttling: We reserve the right to throttle, limit, or suspend accounts that attempt to bypass AI generation limits, reverse-engineer the prompt architecture, or otherwise abuse the API endpoints.

5. Intellectual Property

The original code, database architecture, UI/UX design, and proprietary prompt engineering systems that power AIWOD are the exclusive property of AIWOD. You may not copy, modify, distribute, sell, or lease any part of our Service without our explicit written consent.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AIWOD, ITS FOUNDERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

(A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
(B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
(C) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR
(D) PHYSICAL INJURY RESULTING FROM WORKOUTS GENERATED BY THE PLATFORM.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions.
